Reservation contract General 1.1 These general terms and conditions ("Booking Contract") are concluded between the owner or manager ("we" and "our") and the customer (s) booking our accommodation ("Accommodation") via the website of Reservation. They are binding. The terms "you" and "your" refer to the person making the reservation and to all holidaymakers associated with the booking. 1.2 All reservations are governed by the Booking Contract. Nothing in this Booking Agreement affects your rights under applicable law. 1.3 For payments relating to your reservation, we will use our own services. No commitment, interpretation or promise will be deemed to be actual or implicit as a result of what was said or written in the negotiations between you and us prior to the receipt of the confirmation e-mail, with the exception of is expressly stated in this Booking Agreement. Neither you nor us shall have recourse in connection with any misrepresentation made by the other party, upon which the latter relied at the time of the conclusion of this Booking Contract (unless such declaration is intentionally fraudulent), and this party´s sole remedy shall be to denounce the breach of this Booking Agreement in the manner provided therein. 11.4 We shall not be deemed to be the cause of a violation of this Booking Agreement, nor responsible for any failure or delay in its performance resulting from circumstances beyond our reasonable control, such as a flood, a fire, explosion or accident.
